Riba al-Nasi’ah: With a Special Reference to the Commentaries of Sahih Muslim on Bab al-Riba

Abstract

Hadith collections and their commentaries are one of the primary resources on Islamic jurisprudence. Taking the renowned Jami’ al-Sihah alone as an example, there is not least than sixteen commentaries, from which guidance can be sought and ahkam can be derived. Thus,  suffice to be a clear evidence to the Muslim’s abundant references and sources. Al-Imam Muslim, without making any repetition, had carefully accumulated thirty two authentic hadiths concerning riba. The usurious transaction, particularly in the case of riba al-nasi’ah always occur in the form of loan and credit, that wittingly and unwittingly practised in every day life even among Muslims themselves.

Revisiting the Muslim Feminists’ Discourse on Gender Equality

Abstract

The concept of gender deals with women’s and men’s place in society and social expectations from them. Gender relations vary from society to society and they are shaped in historical process. Gender equality, concisely defined as equal rights, opportunities and treatment between men and women, is yet an on-going contentious concept among Muslim feminists and women activists. Of late, gender studies have garnered a large number of interests from researchers across the globe, not to mention the Muslim World. The awareness of gender and Feminism in Muslim societies emerged by end of 19th century, namely in Middle East countries like Egypt, Turkey and Iran. Initially, Muslim women’s movement had been focusing on claiming women’s rights in public sector particularly in education, along with the Nationalism campaigns. However, as the Muslim feminist scholarship expands and grows, the discourse is shifted to contending Islamic Law pertaining women, attempting to reinterpret and re-read Islamic sources, and eventually reconstruct the Shari’ah or Islamic Law.The Muslims by and large are looking into this debatable notion from three standpoints. First, those who advocate total equality between men and women in every spheres of life, regardless of the differences in the natures and traits between both parties, physically and psychologically. Second, at the opposing end those who deny much of women’s rights and inevitably practice bias towards women in their customs and traditions, which subsequently create some kind of defensive and rebellious reactions from women. Third, those who advocate the moderate approach in dealing with gender issues, and seeking for the best appealing viewpoint by highlighting the ‘complementary idea’ in men-women relation. Hence, this paper attempts to revisit the trajectory of Muslim feminists and put forward the discursive notion of gender equality among Muslim scholarships, accentuating the various perspectives and approaches in dealing with it. It proposes that even though gender is not specifically discussed as a distinctive theme in Islam by early Muslim scholars, it nevertheless allocates distinctive status, rights and opportunities for women, corresponding to their distinctive natures and traits.

Manifestasi akhlak menerusi  unsur-unsur alam dalam beberapa karya Raja Ali Haji

Abstrak

Kertas kerja ini bertujuan untuk membincangkan mengenai peranan alam dalam menzahirkan sistem akhlak dalam masyarakat Melayu pada abad ke-19 Masehi. Penelitian dan penaakulan akal terhadap unsur-unsur alam yang berada di sekeliling diterjemahkan melalui bahasa sebagai medium untuk memperolehi ilmu yang benar dan mencapai keelokan akhlak serta budi pekerti. Pendekatan analisis konten digunapakai bagi meneliti beberapa karya Raja Ali Haji (1808-1872), seorang pujangga agung kelahiran Riau yang terdidik dalam sistem tradisi keilmuan Islam. Hasil kajian mendapati bahawa dalam masyarakat Melayu Nusantara, alam bukan sekadar dianggap sebagai tercipta untuk kesenangan hidup manusia malah ia turut berperanan untuk memanifestasikan ketinggian akhlak yang bertunjangkan kepada pandangan semesta Islam.

Solat Jenazah

Daripada Abi Hurayrah r.a.  bahawa Rasulullah SAW telah bersabda : Sesiapa yang menziarahi jenazah seorang muslim dengan penuh perasaan keimanan dan tetap berada bersama jenazah sehinggalah ianya disolatkan dan turut serta sehingga selesai ia dikebumikan, maka dia pulang dengan mendapat 2 qirat. Setiap satu qirat ganjarannya sebesat Bukit Uhud. Manakala sesiapa yang solat jenazah, kemudian dia pulang tanpa menunggu sehingga jenazah  tersebut dikebumikan, dia mendapat 1 qirat. (Sahih Bukhari)

Solat jenazah merupakan antara solat yang sangat mudah dan ringkas, namun tidak semua berebut-rebut untuk melakukan tanggungjawab fardu kifayah ini.  Lebih-lebih lagi kaum wanita. Kita tidak dibiasakan dengan amalan solat jenazah walaupun untuk keluarga terdekat.

Berikut adalah cara-cara untuk solat jenazah:

1.Niat: Sahaja aku solat jenazah ke atas mayat ini 4 takbir mengikut imam kerana Allah ta’ala.

2. Takbir 4 kali.

3. Selepas takbir pertama, baca al-Fatihah

4. Selepas takbir kedua, baca selawat

5. Selepas takbir ketiga, baca doa untuk jenazah

6. Selepas takbir keempat, beri salam.

Solat Istikharah

Ada yang hantar sms bertanya bagaimana cara nak solat istikharah. Solat istikharah adalah solat sunat yang dilakukan untuk memohon agar Allah memberi petunjuk untuk kita membuat pilihan dalam urusan kita. Selalunya dilakukan  oleh masyarakat Melayu dalam urusan pemilihan jodoh. Tetapi sebenarnya solat istikharah ini sepatutnya dilakukan untuk setiap urusan penting kita, bukan setakat urusan perkahwinan. Bak sabda Nabi Muhammad s.a.w: Tidak akan menyesal orang yang beristikharah dalam menentukan urusannya.

Cara

Sepertimana solat sunat biasa. Dua rakaat. Boleh dilakukan pada bila2 masa (sebaiknya tidak dilakukan pada waktu2 yang diharamkan utk solat sunat).

Niat: Sahaja aku menunaikan solat istikharah 2 rakaat kerana Allah ta’ala.

Bacaan: rakaat pertama: Al-Fatihah dan al-Kafirun
rakaat kedua: Al-Fatihah dan al-Ikhlas

(Boleh juga dibaca surah2 lain selain yang disebutkan selepas membaca al-Fatihah. Kalau tak hafal, baca al-Fatihah aje pun memadai)

Selepas memberi salam, beristighfar dan membaca al-Fatihah, hendaklah dibaca doa ini:

Doa Solat Istikharah

Ya Allah, hamba memohon agar memilihkan untukku mana yang baik menurut ilmuMu dan hamba memohon kepastian dengan ketentuanMu dan hamba memohon dengan kemurahanMu yang agung. Kerana sesungguhnya Engkau sahaja yang Maha berkuasa sedangkan hambaMu ini tidak mempunyai kemampuan . Engkau Maha Mengetahui sedangkan hambaMu ini tidak mengetahui.. Dan Engkaulah Tuhanlah Yang Maha Mengetahui segala sesuatu yang tersembunyi.

Ya Allah jika Engkau mengetahui bahawa urusan ini terbaik buatku dalam perkara agamaku, penghidupanku di dunia dan kehidupan akhiratku, maka taqdirkanlah dan permudahkanlah ianya untukku serta curahkanlah melaluinya keberkatan bagiku.

Sebaliknya jika Engkau mengetahui bahawa urusan ini bukannya yang terbaik buatku dalam perkara agamaku, penghidupanku di dunia dan kehidupan akhiratku, maka jauhkanlah ia daripada ku, dan jauhkan aku daripadanya. Takdirkanlah yang terbaik buatku. Kurniakanlah kebaikan di mana saja ia berada dan jadikanlah aku ini orang yang redha atas ketentuanMu.
